Citizens of Utah... WAKE THE HELL UP!!

Have you bought motor oil at Wal-Mart lately? Have you been asked to bend over at the register, while the cashier scanned your Quaker State, Havoline, or Mobil oil purchase? Or, perhaps you were bent over by the cashier without noticing it? Look at your receipt! Here's the deal...

Title 40 (40-6-14) of the Utah Code establishes a "Fee on oil and gas", and it reads:

"(1) (a) There is levied a fee as provided in Subsection (1)(b) for oil and gas:

(i) produced; and
(ii) (A) saved;
(B) sold; or
(C) transported from the field in Utah where the oil or gas is produced.

(b) The fee imposed under this Subsection (1) is equal to the product of:

(i) .002; and

(ii) the value of the oil or gas determined in accordance with Section 59-5-103.1."

(2) (a) The State Tax Commission shall administer the collection of the fee, including any penalties and interest.
(b) The money collected shall be deposited in the Oil and Gas Conservation Account created in Section 40-6-14.5.
(c) Time periods for the State Tax Commission to allow a refund or assess the fee shall be determined in accordance with Section 59-5-114.
(3) (a) Each person having an ownership interest in oil or gas at the time of production shall be liable for a proportionate share of the fee equivalent to that person's ownership interest.

So, what does all that crap mean? It means that there is a "fee" imposed upon "Each person having an ownership interest in oil or gas at the time of production" equal to 2/10 of a penny. (Section 59-5-103.1 is simply the statutory authority establishing the Utah State sales tax, and explains how much and for what goods and service sales tax will be chaged.)

Nowhere in the statute does it charge this "fee" to the retail seller, nor does it allow the retail seller to pass the fee along to the end user. Further, according to the statute, the "fee" is only placed upon oil and gas that is produced; and saved; sold; or transported from the field in Utah where the oil or gas is produced. However, Wal-Mart (and possibly other retail sellers of oil in Utah) charges a 4¢ ($0.04) "oil use fee" on one quart of motor oil. If the sales unit is a U.S. quart, then the fee charged by Wal-Mart is 20 times what the State of Utah authorized. This raises four questions in my mind:

1. Was that quart of Quaker State motor oil produced; and saved, sold or transported from the field in Utah where the oil was produced?

2. Under what statutory authority does Wal-Mart collect the "oil use fee" from the end user (purchaser) when the fee is imposed upon - and supposedly paid by - the oil producer?

3. Why hasn't the State either (a) stopped this practice of passing the fee along to the customer, or (b) amended the Utah Code, Title 40, to permit the practice of passing the fee along to the customer, but at no more than the prescribed rate of .002 per unit.

4. Who's bending us over further, Wal-Mart with its illegal practice, or the State of Utah for permitting it to continue?

It's not just a few pennies we're talking about here. Well, okay, it is just a few pennies for each of us individually, but Wal-Mart is probably raking in several thousands of dollars per day in illicit profits. And, they're doing it 4¢ at a time in their Utah stores!

And, the State of Utah can call it a "fee" all they want... it's just another TAX... in fees clothing! Somebody has apparently determined that we have too much disposable-by-choice income left after paying bills and all the other taxes with which we've been burdened by your government...

Government Control Is Not Needed Where Obama Wants It!!

Your government wants to stick it's bureaucratic nose into everything that affects average, working-class people. Everything except those areas it should be investigating and regulating more strictly! For example...

"NEW YORK (CNNMoney.com) -- Exxon Mobil Corp. reported quarterly earnings Thursday that easily beat analysts' expectations on higher crude prices.

The world's largest public energy company reported net income of $7.56 billion, or $1.60 a share, in the second quarter, up 91% from $3.95 billion, or 81 cents a share, in the same period in 2009.

Earnings for the first half of 2010, excluding special items, were $13.9 billion, up 60% over the first half of 2009." (Emphases added)

Yes, my friends, that is Billion with a capital "B". The concept of a million of anything is difficult for most of us to envision, and the term billion just boggles the mind. Maybe this will help get it into perspective - a billion minutes ago, Christ was alive. Here's a picture showing the relationship between one thousand, one million and one billion -

There is a 6" difference between the million point and the billion point on this line. (A trillion [a figure our government loves to throw at us] would be marked 500 feet to the right of the billion mark.) Now, think of that number in terms of dollars - the dollars you spend at the gas pump, the dollars you spend for groceries, the dollars you spend for clothing... and your tax dollars!

Diesel fuel, the least refined and least expensive to produce, currently hovers at around $4 per gallon. More than premium gasoline! Do you still wonder why the cost of "goods and services" is skyrocketing upward? Understand that goods do not magically appear in Wal-Mart at the beginning of each business day, nor do groceries breed on the shelves of your local Kroger or Safeway grocery stores when the lights go out. These items are transported to every retail store in our country by diesel-fueled delivery vehicles, whether they be 18-wheelers, railroad trains, or a combination. The oil companies have taken our nation hostage! And your government has not done - or even said - a thing about it. It's areas like this that we need government mandated price caps! The workers of this nation need gasoline to get to and from their place of employment in order to earn a living so they can afford to buy those goods and services. Gasoline now costs between $3.25 and $3.65 per gallon and the price is increasing almost daily! The excuses used by big oil are "There's unrest in Saudi Arabia", "The middle east crisis is driving our costs up", and "It's the Yemeni problem". What's wrong with this picture? The problem is Big Oil's corporate GREED! Individually, or even collectively, We The People can do next to nothing about it directly. Government intervention mandating price caps is the only solution.

How do we get that done? Write, email, or telephone your elected Congressional Representatives - including Senators - and tell them that We The People need relief from the price gouging oil corporations economy-crushing GREED!

(Because our national economy is "in the dumper", China is campaigning at the U.N. to have the U.S. dollar replaced by the Chinese yuan as the "reserve currency". For those of you who may not know exactly what the "reserve currency" is, it is the global currency of international trade. If China is successful in their bid, it will further diminish the U.S. in the eyes of "the global community".)

MANDATORY HEALTH INSURANCE... Does That Sound "American" To You?

Our left-wing D.C. legislature has modified the Obama-Care bill to include one particularly interesting feature. If you fail to purchase health insurance, at a cost of up to $1,900 annually, you will qualify for a "penalty" of up to $25,000 or imprisonment for up to one year.

Here's what leapt immediately into my mind... if you can't afford the "up to $1,900" for "government approved health insurance", your ass is going to jail! Why? If you had $25,000 lying around to play with, you'd probably have bought the health insurance to begin with. Yep - you just can't buy any health insurance you want... no, no, no! It must be "government approved"!

Great... so now we have an annual increase in our prison population of (just a conservative guess) 500,000 per year. That's another half-million people that are now tax supported instead of tax paying - and they're now getting their medical treatment for free! Another clever move by our government officials...

Now throw in the loophole designed to cover the insurance companies - which goes something like this:
If they elect not to cover you for certain contractually obligated treatments... THAT'S OKAY!
The latest version of the universal health care bill stipulates that the insurance companies will not be held liable in those instances. Sweet deal for them, eh? Collect those premiums, and then tell you to 'go pack sand' when it's their turn to shell out some money. Unbelievably, this is considered acceptable behavior by our legislators. Do you think that maybe.... just maybe...the majority of our elected Dumocratic representatives are in bed with the insurance industry?

At the other end of the spectrum we have those folks in the rarefied atmosphere of multi-whatevers - multi-millions, multi-billions, etc. They can afford not to pay for health insurance, and may choose to bet on the fact that they will stay relatively healthy for a very long time. If and when they do need health care, they can easily afford to be "self-insurers". Will Bill Gates, Tiger Woods or Warren Buffett go to prison for not anteing up? Not a snowball's chance... $25,000 is lunch money to them. Therefore, the specified penalty of 1 year in jail for not having health insurance is designed to be, and is de facto punishment for being poor. Congratulations! Being poor is now a crime, and you are now a criminal!

2010 is an election year for Governors and Congressional reps. The smart thing for Americans to do is throw all the incumbents out... but, most Americans didn't do the smart thing in the last election, so why would we expect a different behavior this time? Replacing them all will serve three purposes - (1) It will be a sort of "revenge" for them screwing us over for decades, (2) it may even gain the attention of those who are chosen to replace them... a "wake-up call", if you will, and (3) it will remind them that they serve "We the People", and "We the People" are not happy with their performance.

Obama's Belgrade Montana "Town Hall Meeting" SCAM Unveiled

I received most of the following as a forwarded email, originated by a local resident of Belgrade Montana, regarding the "Presidential Town Hall Meeting" held there on August 18th. I personally have no knowledge of the accuracy of any of it, but it does support my assessment of Friday, August 14th, regarding the staging of the meeting and the general makeup of the audience.

SMOKE & MIRRORS, TRUCKED IN GANGS, SELECTIVE TICKET HOLDERS AND PRE-SUBMITTED QUESTIONS.
By now you have probably heard that President Obama came to Montana last Friday. However, there are many things that the major news has not covered. I feel that since Joe and I live here and we were at the airport on Friday I should share some facts with you.

On Wednesday, August 5th it was announced locally that the President would be coming here. There are many groups here that are against his healthcare and huge spending so those groups began talking and deciding on what they were going to do. The White House would not release ANY details other than the date.

On about Tuesday Joe found out that they would be holding the "Town Hall" at the airport. (This is only because Joe knows EVERYONE at the airport) Our airport is actually located outside of Belgrade (tiny town) in a very remote location. Nothing is around there. They chose to use a hangar that is the most remotely located hangar. You could not pick a more remote location, and you cannot get to it easily. It is totally secluded from the public.

FYI: We have many areas in Belgrade and Bozeman which could have held a large amount of folks with sufficient parking. (gymnasiums/auditoriums). All of which have chairs and tables, and would not have to be SHIPPED IN!! ($$$$$)

During the week, cargo by the TONS was being shipped in constantly. Airport employees could not believe how it just kept coming. Though it was our President coming several expressed how excessive it was, especially during a recession. ($$$$$)

Late Tuesday/early Wednesday the 12th, they said that tickets would be handed out on Thursday 9am at two locations and the president would be arriving around 12:30 Friday.

Thursday morning about 600 tickets were passed out. However, 1500 were printed at a local printing shop per White House request. Hmmmm......900 tickets just DISAPPEARED.

This same morning someone called into the radio from the local UPS branch and said that THOUSANDS of Dollars of Lobster were shipped in for Obama (Montana has some of the best beef in the nation, and it would have been really wonderful to help out the local economy!) Anyone heard of the Recession?? Just think...with all of the traveling the White House is doing ($$$$$). One can only imagine what else we are paying for.

On Friday Joe and I got out to the airport about 10:45am. The groups that wanted to protest Obama's spending and healthcare had gotten a permit to protest and that area was roped off. But that was not to be. A large bus carrying SEIU (Service Employees International Union) members drove up onto the area (illegal)and unloaded right there. It was quite a commotion and there were specifically 2 SEIU men trying to make trouble and start a fight. Police did get involved and arrested the one man but they said they did not have the manpower to remove the SEIU crowd.

The SEIU crowd was very organized and young. About 99% were under the age of 30 and they were not locals! They had bullhorns and PROFESSIONALLY made signs. Some even wore preprinted T-shirts. Oh, and Planned Parenthood folks were with them... professing abortion rights with their T-shirts and preprinted signs. (BTW, all these folks did have a permit to protest in ANOTHER area)

Those against healthcare/spending moved away from the SEIU crowd to avoid confrontation. They were orderly and respectful. Even though SEIU kept coming over and walking through, continuing to be very intimidating and aggressive at the direction of the one SEIU man (apparently the head thug).

So we had Montana folks from ALL OVER the state with their homemade signs, and their DOGS with homemade signs. We had cowboys, nurses, doctors you name it. There was even a guy from Texas who had been driving through. He found out about the occasion, went to the store, made a sign, and came to protest.

If you are wondering about the press... well, all of the major networks were over by that remote hangar I mentioned. They were conveniently parked on the other side of the buildings FAR away. None of these crowds were even visible to them. I have my doubts that they knew anything about the crowds.

We did have some local news media around us from this state and Idaho. Speaking of the local media...they were invited. However, all questions were to be turned into the White House in advance of the event. Wouldn't want anyone to have to think off the top of their head.

It was very obvious that it was meant to be totally controlled by the White House. Everything was orchestrated down to the last detail to make it appear that Montana is just crazy for Obama and government healthcare. Even those people that talked about their insurance woes... the White House called our local HRDC (Human Resource and Development Committee) and asked for names. Then the White House asked those folks to come. Smoke and mirrors... EVERYTHING was staged!!!!!!!!!!!

I am very dismayed about what I learned about our current White House. The amount of control and manipulation was unbelievable. I felt I was not living in the United States of America, more like the USSR!! I was physically nauseous. Joe and I have been around when Presidents or Heads of State visit. It has NEVER been like this. I am truly very frightened for our country. America needs your prayers and your voices. If you care about our country please get involved. Know the issues. And let Congress hear your voices again and again!! If they are willing to put forth so much effort to BULLY a small town one can only imagine what is going on
in Washington DC. Scary!!

This may be the closet thing to the truth that the American public will ever see about Obama's Montana town hall meeting. I performed due diligence, and researched all the newspapers (the 3 B's - Bozeman, Billings, and Belgrade) in that area for further information about the attendees, and found nothing about the rank and file citizens, other than a few pre-approved questions that were asked of The Usurper. There was no mention of busloads of SEIU members, or of even minor confrontations... nor was there any mention of a single difficult question being asked. According to the media, everybody loved Obama and his National Health Scare Plan.

This could be explained, according to Sue, by the placement of the national media out of view of the health plan protestors. That, together with media's love affair for Übermeister Obama makes for very slanted reporting. Interestingly, our local town hall meeting in Grants Pass, OR was also heavily attended by SEIU members. Until then, I had never before seen anyone in Grants Pass wearing an SEIU T-shirt (The Service Employees International Union is the largest and fastest growing union in North America.)

The closest information I could find reflecting anything even slightly negative about the Montana town hall meeting was in the Belgrade (Montana) News: "Most people in the largely Obama-friendly crowd were favorable of the president's funding formula." The fact that it was "largely Obama-friendly" is most likely due to the busing in of supporters from outside the Belgrade area, and the White House's total orchestration of the event. (Look at it this way - if you were throwing a party, would you invite - and be surrounded for an hour or more by - people you knew didn't like you? As Homer Simpson might say... "DOH!" (Granted, Homer is neither a great intellect nor a respected philosopher, but he does recognize stupidity [at least after the fact] when he has been a part of it. Oh, and for you liberals who may think The Simpsons is a "reality show"... IT'S A CARTOON!)

Each day, more and more liberals are slapping their foreheads and going "DOH!" as they reflect upon their choice for President of the United States of America. Obama has eight months in office and has yet to keep one promise he made to the American people! However, with the creation of his Czar Zoo, he has obviously kept his promises to his political allies and fund raisers.

Exactly how stupid are the American people? Watch closely as Obama pushes the envelope in his attempts to make that determination! SMOKE AND MIRRORS..........

"TOWN HALL MEETING" Defined - Obama did NOT have one in Montana

A town hall meeting is an informal public meeting derived from the traditional town meetings of New England. Similarly to those meetings, everybody in a community is invited to attend, voice their opinions, and hear the responses from public figures and elected officials.

That, my friends, describes how a Town Hall Meeting should be conducted! However, your illustrious President, His Royal Highness and Messiah, Barack Hussein Obama turned the meeting in Montana into a lecture, simply stumping for his socialistic "universal Health Care" program. As you may have noticed from my previous blog posting, this was an unsurprising tactic. Obama's audience was carefully chosen to insure there would be no dissenting opinions expressed as he, once again, bamboozled the American public with yet another well-received speech. There was no doubt going in that this campaign tactic would work in his favor, inasmuch as he, his staff and his Secret Service detail insured that those opposed to expanding government and government controls over our private lives would be denied entry into the event.

Montanans, on the whole, are neither followers nor political lapdogs - they are independent, hard-working, self-sufficient, conservative citizens who are still imbued with much of the pioneer spirit of the 19th century American West. The true spirit of Montana was not accurately represented at Obama's "Town Hall Meeting"... but, what else can we expect from the smoke and mirrors philosophy of this administration?

There is transparency in this administration, but you have to be willing to remove those rose-colored glasses and actually look through the smoke screen. What one sees is not a better America, but simply an attempt to change America into a European-style socialist nation, ruled by government and special interest groups as opposed to representing, reflecting, and preserving the will of the people and the Constitution of the United States of America! Obama also seems intent upon insuring American energy needs remain hostage to the greed of his middle-eastern, Muslim brethren.

The acceptance of this so-called "Town Hall meeting" as being anything other than deliberate, choreographed political theater should be an embarrassment to us all... and shame on those of us who see it as anything other than the political sham it was!

Obama's 4 Ds - Disagreement, Disregard, Disenfranchisement, and Disinformation

It should have come to our attention by now that your "President" does not appreciate having his desires and actions questioned, for He is "The One". Oh, yeah ... he's The One, alright. He's the one whose only proven organizational ability is that of "Community Organizer", a "job" in which his primary function was to teach people how to be loud, boisterous, and civilly disobedient. He also trained them in how to be disruptive to those conducting the business of government, and how to refuse to take "NO" for an answer.

Now, when truly disappointed, frustrated and angry citizens attend "Town Hall Meetings" and demonstrate that disappointment, frustration and anger to their elected representatives, through their general demeanor and passionate, heart-felt outbursts Obama and his left-wing allies cry "foul". The Democraps seem to believe that when the left does these same things, it's just honest emotion, and therefore fine with them. But... when anybody who can see through the smoke, mirrors and misdirection of "The One" has the audacity to actually verbalize that belief, they are immediately demonized as "puppets of the wealthy Republicans", "unruly mobs", "racists" and "tea-party loons" by the left. (By the way, the attendees at the nationwide "tea parties" this past April 15th were an amalgam of Americans who are unhappy with the direction Obama and his cronies are taking this country. There were people of every stripe and color - Republicans, Independents, Libertarians, Constitutionalists, and yes... even a few liberals and intelligent Democrats. (We even had some neo-Nazi skinheads - whom we peaceably frustrated - show up at our tea party in Grants Pass Oregon. Their demeanor wasn't the least bit belligerent, but we felt their message wasn't an appropriate one for our rally.) All cultures and colors were represented - whites, blacks, native Americans, Mexicans, and Asians in attendance. There were natural-born citizens and naturalized citizens. There were Christians. Jews, Muslims, Hindus, some of the Orthodoxies (Greek, Russian, etc.), and atheists and agnostics there also. I saw no indication of any significant "wealth" there - no Armani suits, Rolls-Royce automobiles, or Gucci handbags - 99% of the attendees were quite casual in their manner of dress. Among the crowd of about 1,000, there may have been 10 people wearing something other than jeans, tennis shoes/flip-flops or boots, and a t-shirt or pullover. I saw one tie, and two sport coats. These were everyday, working-class folks who were demonstrating their concern about the direction (or is it misdirection?) our government is taking. The left wishes to denigrate those people who make up the backbone of America, and classify them as the "lunatic fringe". After all, one would have to be a lunatic to be in opposition of anything The One wanted done!

"We the People" are tired of being ignored by our elected officials! We are tired of ever-expanding, tax and spend government. We are disgusted with a government which bails out private corporations - to the tune of hundreds of billions of dollars - using taxpayer money to do so. We are sick of ridiculous health care proposals that would euthanize, or at the least, withhold necessary life-saving treatment from the elderly, the disabled, and the chronically ill. We are angered by a government that insinuates itself further into our privates lives, and that ignores our Constitution in order to foist bogus, unnecessary, and expensive social programs upon us. We are confused and frustrated by a government that believes it can borrow - or print - money to recover from a financial crisis, all the while instituting more of the aforementioned "expensive social programs". (We spend our way into bankruptcy, not out of it!)

We are no longer the beneficiaries of government by the people... we have now become the victims of government of the people by the elitist, Marxist-socialist rich. Over 40% of our elected officials are multi-millionaires, and the remainder are just extremely "well-off". A few of those elected "representatives" brought their wealth with them into the office, the others made their wealth from within the office... I can't help but wonder how they made all that money from a job with a starting pay of $174,000 per annum? If they banked their entire pay - without spending so much as a penny of it - for 5.75 years they would just barely qualify as a millionaire. We have the best government that corporate and special interest money can buy!

As far as dissatisfied citizens "forming organized, orchestrated, and choreographed unruly mobs" is concerned... they ain't seen nothin' yet! These town Hall Meetings have, for the most-part, been held in (suprise) town halls. A town hall is generally a small, cramped venue with a capacity of perhaps 200 people in a large town hall. To hold these public meetings in a larger auditorium would allow too many people to attend, thereby taking too much of our elected representatives precious time, and perhaps it would also insure that he or she got an earful of what their constituents actually wanted! That could be disconcerting if the people wanted something that conflicted with what corporate America, the Special Interest groups, PACs and good paying lobbyists wanted. They choose the path of least resistance for themselves when it comes to hearing what people really think. If they want to see a MOB they should wait until 50,000 people march on Washington D.C. - which may happen in the near future.

I could be wrong about this, and your Congressional Representatives and Senators could actually care about you.

Where's The Birth Certificate?

At the risk of sounding like a broken record, I will once again bring up the absence of an acceptable certificate of birth for Barak Hussein Obama. The following actions have been initiated, and most also resolved in some fashion, regarding this situation. The US Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President." (Taken at face value, a candidate would have to be at least 222 years old to satisfy this particular requirement.)

• New Jersey attorney Mario Apuzzo has filed a case on behalf of Charles Kerchner and others alleging Congress didn't properly ascertain that Obama is qualified to hold the office of president.


• Pennsylvania Democrat Philip Berg has three cases pending, including Berg vs. Obama in the 3rd U.S. Circuit Court of Appeals, a separate Berg vs. Obama which is under seal at the U.S. District Court level and Hollister vs. Soetoro a/k/a Obama, (now dismissed) brought on behalf of a retired military member who could be facing recall to active duty by Obama.
  
  
• Leo Donofrio of New Jersey filed a lawsuit claiming Obama's dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.


• Cort Wrotnowski filed suit against Connecticut's secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.


• Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public's support.


• Chicago lawyer Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama's vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.
  
  
• Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama's eligibility could be confirmed, alleging doubt about Obama's citizenship. His case was denied.
  
  
• In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.
  
  
• Also in Ohio, there was the Greenberg v. Brunner case which ended when the judge threatened to assess all case costs against the plaintiff.
  
  
• In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama's citizenship. The case was denied.
  
  
• In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama's birth certificate. His request for an injunction against Georgia's secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.


• California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters. She also has brought forward several other cases and has conducted several public campaigns to generate awareness of the issue.

As you can see, the only actions taken by federal courts thus far is to deny the plaintiffs their "day in court". This does not necessarily mean that these suits are groundless, it means that the federal court system, and the Congress of the United States, have "circled the wagons" in order to protect His Holiness the Democratic Socialist Messiah. The corrupt court system could easily be bypassed if Congress simply demanded irrefutable proof of citizenship.
